Terms of Sale & Use

The seller of record is Mopaier Eternal LLC, organized in the State of Texas, United States.

All enquiries, notices, and requests under these terms should be sent to support@mopaiereternal.com.

By placing an order, the customer represents that they are at least 18 years old and legally capable of entering into a binding contract in their jurisdiction.

This website is not directed to children, and we do not knowingly collect personal information from children under 13.

By browsing this website, creating an account, or placing an order, the customer accepts these terms together with the Shipping Policy, the Aftersales & Cancellation Policy, and the Privacy Notice, each of which forms part of these terms.

Where an individually prepared invoice contains invoice-specific terms, those terms control only that transaction to the extent of any conflict, except where prohibited by applicable law.

Gemstones and precious metals are natural or laboratory-grown materials. Colour, inclusions, saturation, tone, surface character, and finish vary between individual pieces and are inherent characteristics rather than defects.

Photography, rendering, and screen calibration can affect how colour and scale appear. Measurements, weights, and grading information are provided as accurately as available and may reflect supplier or laboratory documentation.

• Unless expressly stated otherwise, prices are shown and charged in United States dollars (USD). Where catalogue checkout expressly offers Chinese yuan (CNY), the customer may instead select CNY before continuing to payment.
• The CNY checkout amount is calculated from the current USD/CNY reference rate available to Mopaier Eternal when checkout begins, plus a 4% currency allowance, and is shown for approval before payment. The CNY amount accepted at checkout is the transaction price for that order; later exchange-rate movements do not change it.
• Applicable sales tax is calculated at checkout where required.
• Prices, availability, and product information may change at any time before an order is accepted.
• Where a price, description, specification, or availability error is identified, Mopaier Eternal may correct the error, decline or cancel the affected order, and refund any amount already collected for that order.

• Submitting an order is an offer to purchase. A contract is formed only when Mopaier Eternal accepts the order and confirms it.
• Mopaier Eternal may decline or cancel an order in whole or in part, including for stock or sourcing reasons, suspected fraud, verification failure, shipping restrictions, pricing errors, or legal restrictions.
• Where an order is declined or cancelled by Mopaier Eternal before shipment, amounts collected for the affected order are refunded to the original payment method.
• Customer-initiated cancellation is governed by the Aftersales & Cancellation Policy.

• Payments are processed by Stripe. Mopaier Eternal does not store full payment-card numbers.
• Orders may be held for identity, address, or payment verification, which can delay fulfilment.
• For ACH and bank payments, fulfilment begins only after the payment has successfully cleared.
• Mopaier Eternal may require additional verification for high-value orders or for orders flagged by fraud-prevention systems.

Shipping availability, timeframes, carriers, signature requirements, declared value, address changes, and delivery-issue handling are set out in the Shipping Policy, which forms part of these terms.

Website checkout is available for delivery within all 50 United States, including Alaska and Hawaii. International purchases are available only after Client Services approval through an individually prepared invoice.

Every sale is a shipment contract. Mopaier Eternal performs its delivery obligation by tendering the shipment to the carrier at origin; it does not undertake to deliver the shipment at a particular destination.

Title and risk of loss pass to the customer when the shipment is tendered to the carrier, except where applicable law requires otherwise. Mopaier Eternal nonetheless arranges signature-required transport with carrier declared value and will assist with the applicable carrier investigation as described in the Shipping Policy.

Where applicable law places the risk of loss on the seller until the customer takes physical possession, that law controls to the extent of any conflict with this section.

Full shipment, carrier, declared-value, and delivery-issue terms are set out in the Shipping Policy at /legal/shipping, and cancellation handling is set out in the Aftersales & Cancellation Policy at /legal/aftersales.

• Except where otherwise required by applicable law, all sales are final once an order has shipped.
• Mopaier Eternal does not accept returns for change of mind, preference, sizing, or other discretionary reasons after shipment.
• Mopaier Eternal does not offer exchanges.
• Resized, engraved, custom-made, and special-order pieces are final sale.
• Approved refunds are issued only to the original payment method.
• Nothing in these terms limits any right or remedy that cannot legally be waived.

• Mopaier Eternal does not provide a separate written or voluntary commercial warranty on its jewelry, gemstones, or custom commissions.
• A warranty applies only where it is expressly included in a written custom invoice or written agreement signed by Mopaier Eternal, and then only on the terms stated in that document.
• Nothing in these terms waives, limits, or disclaims any right, remedy, warranty, or protection that cannot legally be waived under applicable law.

• Custom commissions require a 50% deposit.
• Once received, the deposit is non-refundable, including during the design stage.
• The remaining balance must be paid in full before shipment or delivery.
• Custom quotes remain valid for 5 calendar days, including Saturdays and Sundays. After a quote expires, pricing and availability may be revised.
• Up to 5 client-requested design revisions are included. Additional revisions may incur additional design fees, determined case-by-case and approved by the client before the additional work proceeds.
• Specially sourced gemstones or materials become non-refundable once purchased for the commission.
• Custom-made, special-order, engraved, and resized pieces are final sale.
• Custom commissions are priced individually and may differ substantially from listed store prices. Pricing can be affected by gemstone availability, gemstone market prices, precious-metal prices, material requirements, production complexity, and design requirements.
• Clients may provide a Target Budget. Mopaier Eternal may also establish a Maximum Authorized Budget or an Authorized Variance in writing, and may proceed within that approved range without requesting additional authorization. Mopaier Eternal will not exceed the client's Maximum Authorized Budget without further approval.
• Production estimate — custom production based on a Mopaier Eternal standard design: approximately 1 week, excluding shipping.
• Production estimate — fully original designs created by the Mopaier Eternal design team, and approved customizations of Exotic Collection pieces: approximately 3 to 4 weeks, excluding shipping.
• Production begins only after the required payment or deposit has cleared and after all designs, sizing, gemstones, materials, specifications, and client selections have received final approval.
• These timeframes are good-faith estimates and are not guaranteed completion dates.
• Complex designs, additional revisions, specially sourced materials, or circumstances beyond our reasonable control may require additional time.
• Material delays will be communicated to the client.
• Where a quote or invoice states a different production estimate for a specific commission, that estimate controls that commission.

For a fully original commission that is not based upon an existing or prior Mopaier Eternal design:

• We will not reproduce the exact commissioned design for another client without the commissioning client's explicit approval.
• We may create modified or derivative designs, provided they are not exact reproductions of the commissioned final design.
• We will not place that exact custom design into a future Mopaier Eternal collection without the client's explicit approval.
• We may photograph and display the finished jewelry for portfolio, website, social-media, promotional, editorial, or similar business purposes.
• We will not publicly disclose our CAD files, internal renderings, modeling files, or proprietary design-development process.
• Client-created drawings remain attributable to the client's contribution; internal design-team materials are not treated as client-owned simply because the commission was client-requested. Where a design is identical to the client's original supplied drawing, that contribution is appropriately recognized.
• For commissions derived from an existing Mopaier Eternal design, the client does not acquire exclusivity over the underlying Mopaier Eternal design.
• An optional Exclusive Design / Non-Reproduction Agreement may be available for an additional fee, determined case-by-case. When explicitly purchased and agreed in writing, Mopaier Eternal agrees not to commercially reproduce the specific final design for another client in accordance with that written agreement. This is a contractual non-reproduction commitment; it is not a copyright or intellectual-property transfer unless a separate written agreement specifically provides for such a transfer.

Mopaier Eternal retains ownership of CAD files, production files, technical files, renderings, modeling work, and internal design-development materials created by the Mopaier Eternal design team. Payment for a custom piece purchases the completed jewelry and does not automatically transfer ownership of the underlying CAD or internal production and design assets.

The following are also prohibited:

• Fraudulent orders or payment activity
• Impersonation of Mopaier Eternal or false claims of affiliation
• Unauthorized commercial use of Mopaier Eternal branding
• Automated scraping of product imagery or catalog content
• Unauthorized access to customer accounts
• Interference with website security or the introduction of malicious code
• Unauthorized commercial reproduction of product photography or renderings

All Mopaier Eternal branding, trademarks, photographs, graphics, text, product presentations, renderings, CAD and design materials, and original jewelry designs are owned by or licensed to Mopaier Eternal and are protected to the extent provided by applicable intellectual-property law. Unauthorized reproduction, commercial copying, distribution, scraping, imitation, modification, or exploitation is prohibited. Mopaier Eternal reserves all rights and may pursue remedies available under applicable law.

In the unlikely event that Mopaier Eternal is unable to complete a custom, special-order, or other purchase as agreed due to circumstances beyond its reasonable control — including material or gemstone unavailability or loss, supplier failure, legal or regulatory restrictions, casualty, transportation interruption, or another unforeseen circumstance — Mopaier Eternal may propose a comparable material or gemstone, a revised design, or an adjusted production timeline for the client's approval.

Mopaier Eternal will not substitute a materially different item or exceed the client's Maximum Authorized Budget without approval.

If Mopaier Eternal determines that it cannot reasonably complete the order and the client does not accept an available alternative, Mopaier Eternal may cancel the affected order and refund amounts paid for the undelivered order to the original payment method.

This provision does not alter the non-refundable nature of a custom-order deposit where cancellation is initiated by the client after the deposit has been received.

• Resizing is not included in standard website purchases and cannot be assumed to be available for any piece.
• Resizing and repairs are considered case-by-case, and only for jewelry originally sold or made by Mopaier Eternal.
• Mopaier Eternal does not offer routine cleaning, polishing, inspection, stone tightening, or similar maintenance services.
• Mopaier Eternal will not resize, repair, maintain, or otherwise service an item that has been altered or serviced by anyone other than Mopaier Eternal.
• Quotes are free. The customer pays shipping in both directions, and work begins only after the written quote is approved and the service invoice is paid.
• Items may be sent to Mopaier Eternal only with prior written authorization, a service authorization number, and item-specific shipping instructions.
• Resized and serviced items remain final sale, except where applicable law requires otherwise. Full service terms are set out in the Aftersales & Cancellation Policy at /legal/aftersales.

These terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles, and subject to any consumer-protection law of the customer's jurisdiction that applies and cannot legally be waived.

• If any provision is held unenforceable, the remaining provisions continue in full force.
• Mopaier Eternal may update these terms. The terms in effect at the time an order is placed govern that order.
